Welcome to Vivanta Stays. By accessing or making a booking through our website (www.vivantastays.co.in) and/or using our services, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, please do not proceed with a booking.
1. Applicability
These Terms constitute a legally binding agreement between you (“you”, “guest” or “customer”) and Vivanta Stays (“we”, “us”, “our”). They govern your use of our website, booking platform, and vacation villa rental services. Additional policies (such as privacy policy, cancellation policy, house rules) may also apply and are incorporated herein by reference.
2. Eligibility & Account Registration
Only persons who are legally capable of entering into contracts under applicable Indian law may use our services.
If account registration is required for your booking, you agree to provide accurate, complete and up-to-date information and maintain confidentiality of your account credentials.
You are responsible for all activity under your account.
3. Booking Policy
A booking is only confirmed once payment of the advance amount (as per the specific villa’s rate) is received and we issue a booking confirmation voucher.
Bookings are non-transferable without our prior written consent.
The number of guests and any extra adults/children must be disclosed at time of booking and match at check-in.
4. Rates, Payment & Taxes
Villa rental rates will be as specified at time of booking.
All payments must be made to our authorised business bank account or via our authorised payment gateway. Transfers to personal accounts are not acceptable, and any such payment may not be recognised by us.
You agree to pay applicable taxes, levies or government charges, even if imposed after the booking was made.
If there is a short-charge due to error or omission, we reserve the right to recover the difference or cancel the booking.
5. Check-In & Check-Out
Standard check-in time: 2:00 PM
Standard check-out time: 11:00 AM
Early check-in or late check-out requests depend on availability and may incur additional charges.
6. Guest Responsibility & Use of Property
The villa is booked for holiday purpose only, unless otherwise specified. If you plan to host events, parties or large groups, you must disclose this at the time of booking and obtain our written approval. Additional security deposit or terms may apply.
You must use the property and its furnishings, equipment and amenities responsibly and with due care. Damage, misuse or removal of items will be charged and may lead to forfeiture of security deposit.
The total number of guests staying and any visitors shall not exceed the number confirmed in the booking without our prior written approval.
Activities that disturb the neighbourhood (excessive noise, illicit behaviour, large unapproved gatherings) are prohibited. We reserve the right to terminate stay without compensation if such rules are violated.
7. Cancellation & Refund Policy
Cancellations by the guest are subject to our cancellation terms specified at the time of booking.
Refunds (if any) will be processed in accordance with the method of payment, after deduction of applicable cancellation charges.
Partial payments may be non-refundable as per the booking terms.
In the event we are unable to honour a booking due to property unavailability, we will offer either an alternate villa of similar standard or a full refund.
8. Security Deposit & Damage Charges
Where applicable, you may be required to pay a refundable security deposit prior to check-in.
We will inspect the property post-check-out. Any damage, extra cleaning required or missing items may be charged against the deposit or billed to you.
If repair/replacement costs exceed the deposit, you will be liable for the balance within 7 days of demand.
9. Refunds
Refunds will be credited to the same payment instrument from which the original payment was made unless otherwise agreed.
Bank/processing charges, currency conversion differences (if applicable) may be deducted.
10. Limitation of Liability & Indemnity
We shall not be liable for loss, theft, damage, injury or accident occurring at the villa or during your stay unless caused by our negligence.
You agree to defend, indemnify and hold us harmless from any claims, losses, damages or costs arising from your breach of these Terms or your negligent, willful or unlawful use of the property.
11. Intellectual Property & Content
All material on our website (text, images, logos, layouts) is our property or licensed to us. You may not reproduce, modify, distribute or create derivative works without our express written permission.
If you believe any content on our site infringes your rights, please notify us with appropriate documentation.
12. Modifications to Terms
We may revise or update these Terms from time to time. Continued use of our services after any such change constitutes your acceptance of the new Terms.
We will publish the updated version on our website and indicate the “Last Updated” date.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India.
Disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra (unless otherwise specified by us).
